In the Laws, Plato argues that the legislator should attempt to persuade people to voluntarily obey the laws. This persuasion is accomplished through use of legislative preludes. Preludes (also called preambles) are short arguments written into the legal code, which precede laws and give reasons to follow them. In this paper, I argue that Plato’s use of persuasive preludes shows that he endorses the core features of a public reason theory of political justification. Many philosophers argue that Plato’s political philosophy (...) is deeply at odds with contemporary liberal political philosophy. While Plato certainly does not affirm (and even rejects) some of the main features of liberalism, if it could be shown that he endorses some account of public reason (which is a liberal idea to its core), this would suggest that there is more in common between Plato and liberalism than many philosophers think. Furthermore, if combined with the work of philosophers, like C.C.W. Taylor, this could form a cumulative case against those who argue that there is little in common between Plato’s political philosophy and liberalism. In short, by showing that Plato endorses the core features of public reason, I endeavor to show that there is more in common between Plato and liberalism than is often thought. (shrink)

Democracy has been a flawed hegemony since the fall of communism. Its flexibility, its commitment to equality of representation, and its recognition of the legitimacy of opposition politics are all positive features for political institutions. But democracy has many deficiencies: it is all too easily held hostage by powerful interests; it often fails to advance social justice; and it does not cope well with a number of features of the political landscape, such as political identities, boundary disputes, and environmental (...) crises. Although democracy is valuable it fits uneasily with other political values and is in many respects less than equal to the demands it confronts. In this volume prominent political theorists and social scientists present original discussions of such central issues. In the present research, we examine the relation between leader mindfulness and employee performance through the lenses of organizational justice and leader-member relations. We hypothesize that employees of more mindful leaders view their relations as being of higher leader-member exchange quality. We further hypothesize two mediating mechanisms of this relation: increased interpersonal justice and reduced employee stress. In other words, we posit that employees of more mindful leaders feel treated with greater respect and experience less stress. Finally, we (...) predict that LMX quality serves as a mediator linking leader mindfulness to employee performance—defined in terms of both in-role and extra-role performance. Across two field studies of triadic leader-employee-peer data and dyadic leader–employee data, we find support for this sequential mediation model. We discuss implications for theorizing on leadership, organizational justice, business ethics, LMX, and mindfulness, as well as practical implications. (shrink)

Although it is an increasingly popular assumption that leader mindfulness may positively affect leader behaviors and, in turn, employee outcomes, to date, little empirical evidence supports this view. Against this backdrop, the present research seeks to develop and test a serial mediation model of leader mindfulness. Specifically, we propose that leader mindfulness enhances employee performance and that this relationship is explained by increased leader procedural justice enactment and, subsequently, reduced employees’ emotional exhaustion. We conducted three studies to test this (...) model. Study 1 involved employees from a wide range of organizations in the USA. Study 2 used a sample of leaders and employees from China and measured our model variables at three different points in time. Both studies provide consistent support for our hypotheses. Finally, Study 3 involved a laboratory experiment in which 62 senior executives were assigned to either a mindfulness induction or to a control condition. Again, results revealed a significant and positive link between leader mindfulness and leader procedural justice enactment. In sum, these findings expand our understanding of mindfulness to the domain of leadership, a key area of organizational research. Moreover, they complement prior studies by showing that mindfulness dynamics go beyond intrapersonal effects but also influence the attitudes and behaviors of others. We discuss our findings in light of their contributions to the mindfulness, ethics, and leadership literatures and point out implications for practice. (shrink)

This book originated as lectures for a course on political philosophy that Rawls taught regularly at Harvard in the 1980s.

Social inequalities are partly caused by habitual organizational practices. In this vein, to overcome those, organizations now need to develop new organizational capabilities aimed at enhancing their attention towards societal issues. In our study, we apply the theory of mindfulness to explain how it may help organizations overcome habitual organizing that fuels social inequalities. Guided by the microfoundational perspective of organizational capability, we conceptualize individual characteristics, processes, and structures that collectively form mindfulness capability for social justice. We perceive it (...) as an organizational capability that reflects the extent to which an organization possesses a collective social justice awareness, i.e., awareness of the impact on social justice in society through its organizational practices. We argue that, when adopted by organizations, mindfulness, by increasing the awareness of the organizational impact on society, helps notice, examine, and question the correctness of taken-for-granted organizational practices. From our perspective, this new capability will lead to changes in organizational practices that fuel social inequalities. Our study contributes to the literature on sustainable organizational development and mindfulness research in organizations. Managerial implications and future research directions are also discussed. We argued [Since this argument appeared in other journals, I am reprising it here, almost verbatim.] (Fulda in J Law Info Sci 2:230–232, 1991/AI & Soc 8(4):357–359, 1994) that the paradox of the preface suggests a reason why machines cannot, will not, and should not be allowed to judge criminal cases. The argument merely shows that they cannot now and will not soon or easily be so allowed. The author, in fact, now believes that when—and only when—they are ready they (...) actually should be so allowed, in the interests of justice. Both the original argument applied and this detailed reconsideration applies exclusively to trial courts, and both specifically exclude(d) sentencing. The argument highlights some key relevant differences between minds and machines and attempts, also, to explain why automation is of far greater import for the first-level justice system (trial courts) than for higher courts. How should we respond to political ambivalence when conflicting avenues for political action arise? Some theories of justice, such as objective theories, tell us to follow whatever norms realize a set of independently determined objective goods. I argue such theories are incomplete because they specify political goods to aim at, but do not specify which norms to follow, and thus yield an ineliminable ambivalence. Through analysis of a series of significant obstacles, I show that the objective goods that theorists (...) defend are multiply realizable and thus that different sets of mutually exclusive norms could successfully bring about such goods. I call this set of obstacles “ambivalence” in objective theories of political norms because we must choose between multiple conflicting would-be norms, each of which is compatible with the theory. Objective theories cannot provide direction on these choices and so international norms of justice raise a question about which ambivalence could be appropriate. How should we solve this ambivalence problem? I consider a range of competing alternatives that could complete objective accounts and show that consent through social contract theory presents the best available alternative. I conclude that avoiding political ambivalence on objective global political norms necessitates a consent-based constructivist element. (shrink)

This research investigates 3- and 5-year-olds' relative fairness in distributing small collections of even or odd numbers of more or less desirable candies, either with an adult experimenter or between two dolls. The authors compare more than 200 children from around the world, growing up in seven highly contrasted cultural and economic contexts, from rich and poor urban areas, to small-scale traditional and rural communities. Across cultures, young children tend to optimize their own gain, not showing many signs of self-sacrifice (...) or generosity. Already by 3 years of age, self-optimizing in distributive justice is based on perspective taking and rudiments of mind reading. By 5 years, overall, children tend to show more fairness in sharing. What varies across cultures is the magnitude of young children's self-interest. More fairness (less self-interest) in distributive justice is evident by children growing up in small-scale urban and traditional societies thought to promote more collective values. (shrink)

Filmmaking is one of the most complexly layered forms of artistic production. It is a deeply interactive process, socially, culturally, and technologically. Yet the bulk of popular and academic discussion of filmmaking continues to attribute creative authorship of films to directors. Texts refer to “a Scorsese film,” not a film by “Scorsese et al.” We argue that this kind of attribution of sole creative responsibility to film directors is a misapprehension of filmmaking processes, based in part on dubious individualist assumptions (...) about creative minds. Such a misapprehension is effacing the public value that a more inclusive and accurate understanding of filmmaking offers. By “public value” we mean the potential to enhance social and cultural well-being, particularly in working lives and collaborative undertakings in the screen industries. Better understanding of the systemic and social nature of creativity in filmmaking can potentially help in democratising aesthetics, which we consider a clear public good. (shrink)

In his inaugural lecture as director of the Institute for Social Research at the University of Frankfurt, Horkheimer points out the need for a new understanding of history that avoids the contemporary versions of the Hegelian Verklärung. He synthesizes this challenge with an imperative: to do justice to past suffering. The result of this appeal can be found in the works of the members of the Frankfurt School in the form of multiple, even divergent, trains of thought that (...) reach with unlike intensities the current debates on memory and its link with history. This paper focuses on three of these trains, which can be traced back to different periods of the work of Herbert Marcuse. It intends to systematize and present what can be considered alternative—although not necessarily contradictory—approaches aroused from the same concern over the critical power of nonreconciliatory memory: first, a genealogy inquiry that deconstructs the reified character of the given; second, a recollection of past images of happiness; and finally, a memory of the limits of all attainable freedom. Exploring these three moments, their shortcomings and tensions, may shed light on the complexity and present importance of the challenge they intend to face. (shrink)

Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. This volume of twenty-six essays by as many contributors is published in honor of Herbert Feigl, professor of philosophy at the University of Minnesota and director of the Minnesota Center for the Philosophy of Science. Though the majority of the contributors are philosophers, there are (...) also -- as benefits Mr. Feigl's varied intellectual interests -- representatives of psychology, psychoanalysis, and physics. The first group of ten essays deals with the philosophy of mind, particularly with the mind-body problem, to which Mr. Feigl has devoted much attention. In May 1969, James Foreman interrupted a religious service at Riverside Church in New York to deliver “The Black Manifesto,” which included a stunning “demand” of $500 million in “reparations” for black Americans from the white religious establishment. In the period since that date, The Manifesto has aroused rather less serious discussion than one might have thought it would. No doubt, the burden of The Manifesto has struck many whites and some blacks as so outrageous in its morality, so unrealistic (...) in its politics, so unfeasible in its economics, that intellectuals may have done a public service by consigning The Manifesto to relative neglect. Not that The Manifesto has had only unfavorable publicity, nor that the churches have ignored it; quite the contrary. What remains true, however, is that the crucial burden of The Manifesto, indeed, the precise argument it advances for reparations and compensatory justice, has not so far as I can tell received the thoughtful attention it deserves. Until it does, and is appraised with care and fairness, it is impossible either to support or to reject The Manifesto's “demands.” Let us try, then, however belatedly, to state and assess the argument of The Black Manifesto. An organisation which operates without a ‘self-concept’ of its goals, authorised roles, governance procedures regarding sharing information, decisional powers and procedures, and distribution of benefits, or without continuous audit of its impact on its end-users, other players in the practice, and the state, does so at some ethical risk. This paper argues that a quasi-personal model of the collective ethical agency of organisations and states is helpful in suggesting some of these key areas which are liable to need careful organisational (...) design and control by leadership groups if the organisation as a whole entity (directors, operators, enablers) steered by the board/CEO as ‘mind/will,’ is to identify its stakeholders - internal and external - and treat them well. Such a quasi-personal model is outlined (QPM) in which six suggested areas should be covered by the leadership group in ethical governance: goals, roles, decision procedures, execution/verification, relations with endusers and other players in the practice, and relations with the community and the state. The ethical conception presupposed is Neo-Aristotelian Virtue Ethics (NAVE). In subsequent papers the many advantages of QPM/NAVE which will be claimed are these: it comes with an analysis of justice which straddles individuals, families, communities, markets, and states; it offers a more coherent normative account of ‘stakeholder’ and the internal/external stakeholder distinction, by differentiating their descriptive, ethical, and causal relations to the firm as collective agent; and it suggests that business practice and business corporations are partly creatures of the state, and merely one kind of evolving and changeable institution, in a practice with a specific socio-political permit, (not the source of ethics, politics, and social policy). This essay is concerned with the question of what kind of economic system would be needed in order to realize Rawls’s principles of social justice. Hitherto, debates about ‘property-owning democracy’ and ‘liberal socialism’ have been overly schematic, in various respects, and have therefore missed some of the most important issues regarding the relationships between social justice and economic institutions and systems. What is at stake between broadly capitalist or socialist economic systems is not in fact a simple choice (...) in a single dimension, but rather a range of choices across a range of different dimensions. This essay, then, has a dual objective: first, it aims to provide a richer account of this normative territory, while showing how issues of economic democracy, decommodification and the limits of markets, and the role of democratic economic planning, all raise questions of justice that are not well captured by focusing only on questions of ownership. Second, it aims to show how the case for democratic socialism can be developed from Rawlsian foundations, in a way that is sensitive to the normative affinities between Rawlsian liberal egalitarianism and democratic socialism, and which attends carefully to the different kinds of institutional elements which a stable, just, and democratic society would require. Taking these aims together, the hope is that we can move onward to a richer debate about the ways in which the realization of democratic socialist institutions may be seen as a requirement of social justice. Previous research showed justice sensitivity – the tendency to perceive and negatively respond to injustice as a victim, observer, or perpetrator – to be reliably and validly measurable in middle childhood, but unexpected findings concerning mean values and measurement invariance require replication, and retest reliabilities, longitudinal relations with prosocial and aggressive behavior, and relations with teacher ratings are currently unknown. This study, therefore, examined mean values, factor structure, retest reliabilities, and MI of self- and parent-rated JS as well as (...) their relations with parent- and teacher-rated prosocial and aggressive behavior and a range of social skills in a sample of 1,329 children between 5 and 12 years of age. Using self- and parent ratings, we could replicate the intended factor structure of three related yet distinct JS subscales. We found strong MI between those ratings. Retest reliabilities of parent ratings were similar to older age groups, but lower for self-ratings. All JS perspectives were positively related with theory of mind and empathy, indicating a good understanding of others’ internal states. Victim JS was negatively related to affective and behavioral self-regulation, whereas observer and perpetrator JS showed positive relations. Victim JS negatively and observer and perpetrator JS positively predicted prosocial behavior. The opposite pattern was found regarding aggressive behavior. This study provides additional support that JS can be measured via self- and other reports in childhood and that it may influence behavior early on. It adds to explaining the relations with prosocial and aggressive behavior. (shrink)

In this article, we develop and defend an account of the normative significance of nonhuman animal agency. In particular, we examine how animals’ agency interests impact upon the moral permissibility of our interactions with them. First, we defend the claim that nonhuman animals sometimes have rights to self-determination. However, unlike typical adult humans, nonhuman animals cannot exercise this right through the giving or withholding of consent. This combination of claims generates a puzzle about the permissibility of our interactions with nonhuman (...) animals. If animals sometimes have rights to self-determination, but lack the capacity to consent, then when, if ever, is it permissible for us to touch them, hold them, bathe them, or confine them? In the second half of the article, we develop a solution to this puzzle. We argue that while we cannot obtain animals’ consent, they can engage in authoritative communications of will through acts of “assent” and “dissent.”. (shrink)

The value of solidarity, which implies mutual concern and support, is often conveyed in our everyday moral and political language. But what is its conceptual relationship with justice? Influential positions in this debate may argue for the opposition between the two concepts: justice is impartial and universal, while solidarity is partial and limited. The present paper aims to shortly explore a range of theories that may exemplify possible answers to this position, from communitarian and realist views, which ultimately (...) confirm the opposition, to political solidarities, which claim an instrumental need for solidarity as a reaction to injustices. Special attention will be paid to Habermas’s compatibilist account of solidarity as the “reverse side” of justice. The paper contends that a compelling answer should preserve the difference between the two spheres and the essential features of solidarity by also sketching a concept of solidarity as a social duty arising from our moral interdependence. One cannot adequately understand the persistence of the achievement gap, Darby and Rury argue, until one knows and understands the history that continues to inflict all varieties of dignitary harm on Black people. The authors deploy the phrase, ‘color of mind’, to describe the deeply embedded attitudinal and institutional norms that diminish the intellect, character, and conduct of Black students – norms with a long history that continue to poison the school system. There is, of course, no dearth of (...) American scholarship on these themes, and the reader may be forgiven for thinking she will encounter little that isn’t already known. Carnell Professor, the most distinguished chair, at Temple University, where he holds appointments in philosophy, religion, and Judaic studies and directs the Institute for the Study of Race and Social Thought and the Center for Afro-Jewish Studies. He is also Ongoing Visiting Professor of Philosophy and Government at the University of the West Indies at Mona, Jamaica. PAGET HENRY is Professor of Sociology and Africana Studies at Brown University. CHIKE JEFFERS is a graduate student in the Ph.D. program of the Philosophy Department at Northwestern University. His interests are in Africana philosophy, social and political philosophy, ethics, philosophy of religion and aesthetics. He is originally from Toronto, Ontario, Canada. CATHERINE JOHN is Associate Professor of African Diaspora Literary and Cultural Studies at the University of Oklahoma. Her book Clear Word and Third Sight: Folk Groundings and Diasporic Consciousness in African Caribbean Writing was co-published by Duke University Press and UWI Press in 2003. She has published several articles on Caribbean literature and culture and her current book project is entitled The Just Society and the Diasporic Imagination. She spends her summer working in Woodside, St. Mary, Jamaica helping with a summer school for children and participating in the community's emancipation celebration. KENNETH KNIES is a doctoral student in philosophy at Stony Brook University. His areas of focus are phenomenology and ancient philosophy. He is also a contributing editor for Political Affairs magazine. EDIZON LEN is a photographer and coordinator of the Fondo Documental Afro-Andino at the Universidad Andina Simòn Bolivar in Quito, Ecuador. In 2006, he was curator of the photo exhibit "The Color of the Diaspora" presented at the Cultural Center of the Catholic University of Ecuador and the University of Tennessee in Knoxville. According Philip Pettit, suitably organised groups not only possess ‘minds of their own’ but can also ‘make up their minds’ and 'speak for themselves'--where these two capacities enable them to perform as conversable subjects or 'persons'. In this paper I critically examine Pettit's case for group personhood. My first step is to reconstruct his account, explaining first how he understands the two capacities he considers central to personhood – the capacity to ‘make up one’s mind’, and the capacity to (...) ‘speak for oneself’ – before showing how he thinks these can be manifested in groups. With Pettit’s account duly reconstructed, I then turn to criticism, arguing that Pettit’s construal of making up one’s mind does not do proper justice to our first-personal self-understanding, nor to our characteristic interpersonal forms of engagement. This leads me, finally, to consider an alternative construal of ‘making up one’s mind’ and ‘speaking for oneself’ that is associated with the work of Richard Moran and whichargue, could usefully be exteextended to groups. All duties are either duties of right (officia iuris), that is, duties for which external lawgiving is possible, or duties of virtue (officia virtutis s. ethica), for which external lawgiving is not possible. – Duties of virtue cannot be subject to external lawgiving simply because they have to do with an end which (or the having of which) is also a duty. No external lawgiving can bring about someone's setting an end for himself (because this is an internal act of (...) the mind), although it may prescribe external actions that lead to an end without the subject making it his end. This article offers a critique of moral individualism. I introduce the topic of moral individualism by discussing how its characteristic assumptions play an organizing role in contemporary conversations about how animals should be treated. I counter that moral individualism fails to do justice not only to our ethical relationships with animals but also to our ethical relationships with human beings. My main argument draws on elements of Wittgenstein’s later philosophy of psychology, and in presenting the argument I address the (...) case of human beings before returning to the case of animals. Given that moral individualists frequently defend what I call the ethical view of animals, i.e., the view that animals are in themselves proper objects of ethical concern, it is worth stressing that it is no part ofmy project to undermine this view. On the contrary, the critique of moral individualism I develop makes available a better understanding of what is right about the idea that animals as such merit certain forms of respect and attention.
